’90 Day Fiancé’: Jay Smith Reportedly ‘Fears for His Life’ if Deported to Jamaica

Jay Smith and Ashley Martson 90 Day Fiancé have always had a tumultuous relationship. The couple was married in Vegas only a single day before Martson caught Smith chatting with women on Tinder. After Smith was caught cheating on Martson again, she decided enough was enough and filed for divorce. The relationship took a toll on Martson, who entered a wellness retreat to deal with depression. Additionally, Smith continued to be a part of her life whether she wanted him to or not. Now, Smith is in ICE custody and could be facing deportation. Allegedly, Smith is concerned for his well-being if sent back to Jamaica. 

The warrant out on Jay

During a conversation with Instagrammer John Yates, Ashley Martson had revealed that Jay Smith already had a warrant out for his arrest. She told Yates, “[Immigration and Customs Enforcement] has already been here to arrest him. They know where he works… I mean obviously if they come to my house at this point, I’m gonna tell them where he’s at. So I’m not sure why he’s still sticking around because we got a letter three weeks ago saying he has an active warrant for his arrest.”

In fact, Jay Smith turned himself in to authorities because of a warrant out on him, related to Martson. We can’t say for sure if it’s the same warrant, but the 90 Day Fiancé star recently received a warrant as a result of breaking a Protection From Abuse order.

Apparently, Martson had to take out a protection order against Smith after discovering that he’d broken into her property while she was on vacation. The order required that Smith no longer discuss Martson on social media, but he didn’t follow through. In fact, he posted about the order on Instagram shortly after receiving it, resulting in his violation.

The 90 Day Fiancé star is currently being held in York County Prison in Pennsylvania, pending future decisions regarding his status in the U.S. Martson told Celebuzz, “Jay and I have a PFA hearing next Wednesday…and then he’ll go back to York Country Prison until he is seen by an immigration judge.” 

Martson also made it clear that she’s not overly thrilled that it’s happening. “This is a very sad situation overall…I’m not popping champagne bottles celebrating today. It’s hard to sit here and think about how he’s sitting in a jail cell right now, but I also have to remember everything he put me through the past year.”

“I was truly in love with him, the finality of this is scathing,” she added.

Fearing for his life 

One of Jay Smith’s friends started a GoFundMe to raise funds for him on Thursday. In the description, they wrote, “Jay fears for his life if he is returned to Jamaica. He is now seen as a traitor who has turned his back on his people and they will assume he has money since he was in America and on an American TV show so that keeps him at a continuously high threat for his safety if he is returned home.”

The fundraiser goes on to make other inflammatory statements, claiming that Jay Smith hasn’t received. The creator, Kayla O’Brien, wrote, “Jay has not received his share of the money for being exploited on this tv show and we are asking help to obtain him a lawyer. Jay arrived here in America as a 20-year-old with a positive outlook, but he has landed in a severely difficult and unjust situation.”
