’90 Day Fiancé’ Star Jay Smith in ICE Custody, Facing Possible Deportation

90 Day Fiancé stars Ashley Martson and Jay Smith have had a challenging year, to say the least. After alleged cheating from Jay Smith, the then-couple underwent divorce proceedings. Martson, however, has since alleged that Jay Smith at first refused to leave her house, and additionally continued to message her afterward. The cheating also exacerbated an ongoing battle with depression, for which Martson sought a wellness retreat. 

Now, Smith is the one dealing with challenges. Martson had previously intimated that Smith could possibly get arrested and deported, and it seems to have become a reality. Smith is currently in ICE custody and could be facing deportation.

Ashley called it ahead — sort of

Previously, Ashley Martson had discussed Jay Smith and his situation with Instagrammer John Yates. She’d told Yates that they were to have a court hearing on August 7 to determine the future of Smith’s status in America. 

Martson told Yates, “He will be deported on August 7 unless he runs, which is what I’m assuming he’s probably [planning].”

In fact, Martson never actually filed for Jay Smith’s status change after marriage. She told Yates, “The thing that’s really frustrating is he’s here illegally now… I did file for his adjustment of status, and then two weeks later he screwed up again, so I withdrew it.”

A warrant out on Jay

Martson then went on to reveal that the authorities were actually already after Jay Smith. “[Immigration and Customs Enforcement] has already been here to arrest him. They know where he works… I mean obviously if they come to my house at this point, I’m gonna tell them where he’s at. So I’m not sure why he’s still sticking around because we got a letter three weeks ago saying he has an active warrant for his arrest.”

It might not be the same warrant, but it’s likely that this warrant is related to Martson’s recent protection order against Jay Smith. Martson took out a Protection From Abuse order against Jay Smith after discovering that he had broken into her property while she was on vacation.

The order required Smith to no longer discuss Martson on social media. Smith posted about the order on Instagram, which is a clear violation. Smith turned himself in to authorities after learning that he had a warrant out on him as a result of the violation.

What happening with ICE?

The 90 Day Fiancé star is currently being held in York County Prison in Pennsylvania. It’s currently not entirely clear what will happen next in terms of deportation. Martson told Celebuzz, “Jay and I have a PFA hearing next Wednesday…and then he’ll go back to York Country Prison until he is seen by an immigration judge.” 

Martson went on to add, “This is a very sad situation overall…I’m not popping champagne bottles celebrating today. It’s hard to sit here and think about how he’s sitting in a jail cell right now, but I also have to remember everything he put me through the past year.”

According to Martson, Smith did everything he could to remain in the country. “He literally did everything he possibly could to get me to freak out because he was informed that if he could prove abuse on his end that he could stay in the country. For a while we were trying to work it out, and then one day he asked me to come over to his house to pick up my passport, and I go over and he has a half-naked girl on his couch,” said Martson. 

“I was truly in love with him, the finality of this is scathing,” she added.
