‘RHONJ’: Teresa Giudice’s Husband Joe Giudice Asks ICE to Release Him as He Awaits Deportation Decision
All Joe Giudice wants is to be reunited with his family. During a bond hearing on September 11, the husband of Real Housewives of New Jersey star Teresa Giudice appeared via video while his lawyer asked a judge to release him from Immigration and Customs Enforcement custody.
Giudice would like to return home to be with his wife and four kids — Gia, 18, Gabriella, 15, Milania, 14, and Audriana, 10 — while he awaits a final decision about whether he can legally remain in the U.S. The judge at Wednesday’s hearing is expected to issue a decision on Giudice’s release from ICE custody next week, People reported.
Joe Giudice has been separated from his family for years
Giudice has been separated from his family since 2016, when he began serving 41 months in prison for mail, wire, and bankruptcy fraud. Though he completed his sentence in March, he remains in ICE custody at the Clinton Correctional Facility in McElhattan, Pennsylvania.
The Bravo star has been stuck in legal limbo since October 2018, when an immigration court ruled that he should be deported to his native Italy after completing his sentence. Giudice was born in Italy and moved with his parents to the U.S. as a small child, but he never obtained American citizenship. Though he is a legal immigrant, as a convicted felon he can be deported. Giudice first appeal of the court’s ruling was denied in April; he’s waiting for a ruling on his second appeal.
“He just wants to be here with his wife, brother and family,” Giudice’s attorney said during Wednesday’s hearing, according to Radar Online. “Law enforcement will be monitoring him, plus the media will be following his every move. So I disagree he is a flight risk.”

While Joe wasn’t present in person at the hearing, his wife Teresa did attend. His mom, sister, brother, and other family members were also there. However, his four daughters did not attend because they were in school. Teresa Giudice also spent 11 months in prison on fraud charges in 2015 after she and Joe were convicted of hiding their assets in a bankruptcy filing.
Teresa Giudice has stood by her husband through their legal troubles. However, it seems that their relationship might not survive his deportation. She’s said she’d be unwilling to follow her husband to Europe if he was forced to leave the U.S.
“I hope that’s not a decision I have to make,” she told Andy Cohen at the Real Housewives of New Jersey reunion. “But like, to pick up my children and just move to another country, I don’t think that would be good for my children. So I mean, so no, I probably wouldn’t.”
Still, Giudice says that being separated from their father would be devasting for the couple’s children.
“If he gets deported, he’ll never be able to go to their graduation[s], celebrate their birthdays, anything,” she told Bravo Insider. “He’s going to be missing out on so much. The girls adore their father, and no child should have to go through what my daughters are going through. They should have their daddy here.”
