As many as five knowledgeable sources report that Johnson & Johnson has discussed paying in excess of $3 billion to resolve lawsuits due to its recalled hip implants, and added that J&J wants to settle as many as 11,500 lawsuits in the United States, and has considered paying over $300,000 per case. A solution such as that would exceed $3 billion in total, if most plaintiffs accept the terms, which is an amount 50 percent bigger than what was proposed in prior discussions. A $3 billion accord would be far larger than the 2001 resolution that Sulzer AG reached with patients who alleged that the company’s hip and knee implants were defective. Sulzer, based in Winterthur, Switzerland, agreed to shell out $1 billion to resolve those suits, which at that time marked the largest settlement involving hip implants.
