Former 90 Day Fiancé: Before the 90 Days star, Geoffrey Pachel is currently in jail after his guilty verdict on October 7th. Geoffrey was found guilty on all three counts, which include aggravated kidnapping, domestic assault, and interference with an emergency call. During the trial, the victim made a mistake that nearly caused a mistrial. This mistake could be grounds for an appeal. Could Geoffrey get out of jail?

The victim, Kristen Wilson, made an error while on the stand

During the trial, Geoffrey’s ex-fiancée, the victim, Kristen Wilson, made an error while on the stand. During her cross-examination, Wilson told the court that while Geoffrey kept her trapped in the bedroom during the attack, he took her phone and deleted old text messages and photos. She revealed evidence that was deemed inadmissible in court.

She said that the photos Geffrey was deleting on her phone were images she took of herself after the defendant had attacked her previously. Geoffrey’s defense team immediately called an objection. The judge admitted Geoffrey’s previous history of domestic violence should have been kept separate from the trial. However, the judge decided that Ms. Wilson’s admission wasn’t enough to call a mistrial. So the trial continued, and the jury found Geoffrey guilty on all three counts. The charges included aggravated kidnapping, domestic assault, and interference with an emergency call.

Geoffrey could file an appeal and get out of jail

Due to Ms. Wilson bringing up inadmissible evidence on the stand, is this grounds for an appeal? Well, according to The Appellate Law Firm, Geoffrey could attempt to appeal his conviction. The website explains, “One of the most common grounds by which defendants seek to overturn their conviction in an appellate case is to argue that the judge at trial improperly admitted evidence against them.”

According to the site, “If the judge improperly allowed evidence to be admitted against you” and “the presentation of that evidence played a significant role in the jury’s decision to convict you,” then there is an option to appeal. This means that Geoffrey’s lawyer could ask the appellate court to reverse his conviction on these grounds.

Geoffrey found guilty on all three counts

After the verdict reading, Geoffrey was taken away to the Knox County Jail for the next few months until his sentencing hearing on December 3rd. With the current charges, Geoffrey is facing anywhere from 8 to 30 years in prison.

According to the experts at CourtTV, had Geoffrey not been found guilty of aggravated kidnapping, he would only be facing around 11 months in jail. However, due to the severity of the crime, eight years is the minimum sentence.

Over a year ago, Geoffrey refused a plea deal because he was confident that he would be acquitted of the charges. There’s no doubt that he will be fighting this conviction.
