Amy Schumer’s Divorce Has Likely Been ‘Months in the Making,’ According to Legal Expert
Amy Schumer filed for divorce from her husband, Chris Fischer. The celebrity couple married in 2018 and welcomed their son, Gene, in 2019. While she has only recently announced her divorce to fans, legal experts explained that the Schumer-Fischer split has likely been months in the making.

On Jan. 6, 2026, Schumer filed for divorce. The couple married in 2018 and welcomed their son, Gene, in 2019. After a period of speculation, Schumer publicly announced that she and Fischer “have made the difficult decision to end our marriage after 7 years.”
“We would appreciate people respecting our privacy at this time. blah blah blah not because I dropped some lbs and thought I could bag a basketball player and not because he’s a hot James beard award winning chef who can still pull some hot tail,” she wrote on Instagram. “Amicable and all love and respect! Family forever.”
On Dec. 1, Schumer said she hoped she and Fischer would “make it through.” After filing for divorce, she noted that they are moving forward amicably.
Legal experts have weighed in on Amy Schumer’s divorce
Schumer, a comedian, has cracked jokes about her prenup. Before her separation from Fischer, she joked on her Instagram Story that she’d never had to utilize it.
“Amy Schumer makes her living from very personal jokes and her life is kind of an open book in that way,” Los Angeles family law attorney Patrick Baghdaserians tells Showbiz Cheat Sheet. “She has been very public, again because she’s joked about it, that she and Chris Fischer have a prenup.”
While Schumer filed for divorce on Jan. 6, Baghdaserians noted that the comedian has likely been separated from Fischer for a long time.
“The timing of all this is very interesting, because last month it was reported in the media that they had sold a Brooklyn townhouse, a day before she announced they were splitting up,” he said. “That suggests this divorce has been months in the making. It would have been in their interest to stay quiet, because when they were selling the townhome they wouldn’t want to go public with a breakup because then whoever was buying the property would treat that purchase like a fire sale.”
He explained that most celebrities engage in divorce negotiations long before filing.
The couple was together for nearly a decade
Schumer and Fischer were first linked in 2017. They kept their relationship private, but in 2018, they quietly married in a small, private ceremony.
“It was kind of an amazing and effortless experience,” Schumer’s stylist, Leesa Evans, told People. “Amy said, ‘Text me when you wake up, Chris and I want to get married.’ And then I called her when I woke up and she was like, ‘Let’s try on dresses today.’ It was literally that of spur of the moment.”
Later that year, Schumer announced her pregnancy.
