Kim Zolciak Insists Custody Loss Is Temporary, Pushes Back on Court Ruling
Kim Zolciak recently lost primary custody of the children she shares with former husband Kroy Biermann. The couple married in 2011 and filed to end their marriage in 2023. Since then, divorce proceedings have dragged on. Biermann filed an emergency motion for sole custody of their four children. After a judge gave him primary physical custody, Zolciak said that this was only temporary.

Biermann and Zolciak share four children between the ages of 12 and 14. He filed an order for immediate change in custody to obtain primary custody, claiming that Zolciak was not present for their children.
In court documents obtained by People, Biermann said Zolciak entered their mediated parenting plan in “bad faith.” He claimed that she left the country and became “wholly unavailable to parent the children in any fashion.” He also claimed that Zolciak missed therapy sessions for their children.
Zolciak has outright denied these allegations.
“These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character,” she said, adding, “I spent five weeks away working on two TV shows to support my family and make sure my children are cared for — something I will never apologize for.”
“I refuse to be bullied or have lies twisted into a narrative about who I am,” she added. “I will not stay silent, the truth is on my side, and it will come to light — no matter how hard anyone tries to bury it.”
Kim Zolciak pushed back on her loss of custody
A judge ruled to give Biermann primary physical custody of their children. While they still share legal custody, Biermann has the final say on decisions related to education, non-emergency medical, and religion.
Zolciak emphasized that this ruling was temporary.
“The judge’s decision … is temporary until our return court date on May 21st when we will have the opportunity for a full hearing,” she told TMZ. “While I want this process to be over for my children more than anything, I am looking forward to our court date on May 21st when we will finally be provided with an opportunity to present the truth.”
Zolciak has previously received limited custody, but it was reinstated after court-mandated therapy.
She accused him of infidelity
When asked about the final straw in her marriage to Biermann, Zolciak said, “He cheated.”
He has also previously accused her of cheating, which she adamantly denied.
“I vehemently deny any allegation that I have been unfaithful to Kroy at any point in our 12-year marriage. Any claim to the contrary is downright false, baseless, and slanderous,” Zolciak said, per Page Six. “I have tried not to speak on these hurtful allegations, but I am at a breaking point with this and I will not stay silent when my character is being assassinated.”
At this point, their divorce proceedings are still dragging on.
