‘RHOBH’: Tom Girardi’s Friends Say Erika Jayne for ‘Left Him to Rot’ After Prison Sentence
Tom Girardi, the former husband of Real Housewives of Beverly Hills star Erika Jayne, is currently serving out a seven-year prison sentence for embezzlement. Because Girardi is 86 years old, his ex-wife believes he will die behind bars. While Jayne said she feels for Girardi, she admitted she has no plans to visit him. His friends have slammed her for this, believing she has abandoned him.
Erika Jayne said she has no plans to visit Tom Girardi in prison
In 2024, Girardi, a former lawyer, was found guilty of stealing tens of millions from his clients. He received an 87-month sentence in 2025.
“It f***ing sucks knowing that person and being married to that person for so long,” she told Sutton Stracke on a recent episode of RHOBH. “Then to see him walk down the courtroom steps like that, knowing he’s going to die in prison, that’s heavy on any level.”
She admitted that she “just kind of hoped he’d die before he’d go to prison, just so he could get it over with.”
While Jayne feels for her former husband, she has no plans to visit him while he serves out his sentence. Girardi received an Alzheimer’s diagnosis in 2021, and Jayne isn’t sure he would recognize her or be able to answer the questions she has for him.
“Would he even want to see me? Would he know who I am?” she wondered. “Is there going to be some magical answer to all the questions I have? No.”

Those close to Girardi view Jayne’s treatment of him as callous. Jayne was also named in the lawsuit against Girardi. A judge ruled that the plaintiffs could not prove her involvement in the fraud.
“The second that things started unraveling, Erika ran for cover and left him to rot,” a friend of Girardi told Radar Online.
Jayne filed for divorce one month before the lawsuit, and Girardi’s friends accused her of only being with him for the money.
“She ditched him the moment the money ran dry,” the source said.
The source added that they want to see Jayne face accountability, just as Girardi did.
“They don’t buy her Miss Innocent act and think she ought to face some justice, too,” the source said. “They haven’t forgotten how she bailed on Tom the moment it suited her, and they’re furious.”
She has moved on with a new partner
While Jayne has not yet finalized her divorce from Girardi, she has moved on to a new romance with veteran John “Shrek” McPhee. She admitted she will likely not marry him.
“No, I don’t think so,” she said, per Bravo. “I’m still married … I don’t know… I don’t want to give anybody these problems, does that make sense?”
Her co-star, Jennifer Tilly, believes that even if Jayne could marry McPhee, she wouldn’t.
“I think she’s looking for somebody to have fun with and, like, a companion or friend,” she said. “Share a good time with, someone who’s good in bed; he looks like he would be good in bed. I don’t really think she’s looking for another husband.”
The couple has been together since the summer of 2025.
