Influencer Kristy Scott filed for divorce from her husband, Desmond Scott, after over a decade of marriage. According to court records, Kristy cited infidelity as the reason for the split. A social media post by Desmond seemed to confirm this. A Texas-based attorney shared how the allegations of infidelity could impact divorce proceedings in the Scotts’ home base.

On Dec. 30, Kristy filed for divorce from her husband, citing alleged infidelity in court proceedings. Desmond addressed the end of his marriage in a Jan. 10 Instagram post.

“I want to begin by apologizing to Kristy, our family, and everyone who has been impacted by the public attention surrounding this situation,” he wrote. “I know this news has been disappointing for many, and I’m truly sorry for the hurt it has caused.”

He noted that at the end of 2025, he wanted to separate from his wife.

“During this period, I made choices that I am not proud of,” he wrote. “I took responsibility for those actions, I shared this with her directly and personally, and ultimately we decided to divorce. I ask for privacy and compassion as we navigate this difficult chapter of our lives. Thank you to everyone who has supported us over the years. I’m grateful for that support.”

Here’s how infidelity could impact Kristy Scott’s divorce proceedings

Austin, Texas-based family law attorney Holly Davis, with the Kirker Davis family law firm, explained that in the aftermath of the split, Desmond should take steps to protect his children.

“It’s salacious for a set of family influencers to go through a divorce involving allegations of infidelity,” Davis tells Showbiz Cheat Sheet. “To minimize any backlash, Desmond should request that the parties not post or share the details of their divorce specifically with their followers, for the children’s sake, and this request should be granted by a Texas court which will want to minimize any disruption of the children’s lives while the divorce is unfolding.”

She explained that even if infidelity was the reason for the split, a court will still likely divide the couple’s assets equally.

“Infidelity is one of many things a court takes into consideration when dividing an estate, but rarely do Texas courts award a highly uneven division of assets in most divorces,” she said. “In this case, reading between the lines, the alleged infidelity in question appears to not be a years-long affair, and there has been no mention yet from the couple of any wasting of assets in pursuit of any affair. If that remains the case, then it is likely a court would divide the estate in a relatively equal way, and we can expect Desmond’s attorney to argue that Kristy’s follower count and potential to earn more money post-divorce should be factored into the division of the estate, to counterbalance the alleged infidelity.”

She predicts that the couple will try to finalize their divorce quickly. If a court prohibits them from sharing information about proceedings on social media, they will likely want to move on to post-divorce content as soon as possible.

She has filed to change her last name

In a divorce petition obtained by Us Weekly, Kristy asked the court to restore her to her maiden name, Small. This is another move that makes it clear that Kristy does not think reconciliation is possible.
