
Kanye ‘Ye’ West Should Get an NDA With Bianca Censori if They Divorce, Lawyer Says

Now, a family law expert says West should acquire a non-disclosure agreement (NDA) if he and Censori divorced.

Kanye “Ye” West and Bianca Censori remain united after a possible brief separation. After their secretive marriage in December 2022, the couple faced public scrutiny. This amplified following West’s controversial actions in early 2025, including the sale of swastika-themed merchandise. These events, as well as West’s controlling nature, allegedly led to Censori leaving and contemplating a permanent split. However, just weeks later, the pair dined together in Spain. Sources close to the couple revealed that they remained committed to working through their issues.
Family trial lawyer Holly Davis spoke to The U.S. Sun about how West will want to “negotiate an NDA” in the event of a possible divorce.
“If Kanye cares about avoiding public embarrassment, which he may not, he will want to negotiate an NDA with Bianca to avoid an exposé into some of the more darker parts of their story, including any possible criminal activity,” Davis warned. “Given Kanye’s current attitude towards free speech, it would be fascinating to see if he believed it applied to divorce proceedings, and in favor of his wife.”
“The only enforceable contracts are written ones, so if they did have a verbal agreement that benefits Kanye, he should be on his best behavior in the divorce to ensure she doesn’t change her mind,” Davis continued.
Kanye ‘Ye’ West named his wife as his power of attorney
In 2023, Kanye West granted his wife, Bianca Censori, a special power of attorney over certain aspects of his financial affairs. This legal designation allows her to make specific decisions on his behalf, such as property management. Unlike a general power of attorney, which provides broad authority, a special power of attorney has limits and often delegates responsibilities during times of personal or professional upheaval.
This move came after West faced significant financial setbacks, including losing major brand partnerships with companies like Balenciaga, GAP, and Adidas due to his controversial statements. Reports suggest that Censori’s role is pivotal in managing West’s business ventures, potentially aiding in the restructuring of his Yeezy brand and addressing legal disputes with former associates.
In May 2025, In Touch Weekly reported yet again that West named his wife as his power of attorney. It’s unclear if this carried over from West’s decision in 2023 or if he had to give her this power again.
Several attorneys agree that Bianca Censori could get more than $5 million in the event of divorce
Kanye “Ye” West and Bianca Censori reportedly have no prenup. Sources claim this means Censori would likely receive around $5 million if she and West divorced. However, Attorney Neama Rahmani of West Coast Trial Lawyers told The U.S. Sun that Censori could receive a lot more money.
“I would advise Bianca to ask for a lot more than the $5 million that was previously reported,” Rahmani said. “California is a community property state, and without a prenup, she is entitled to half of Kanye’s earnings during the past two years, minus any community obligations. Kanye made a lot more than $10 million during this time. … Kanye better make sure she is happy and doesn’t turn on him.”
