Nick Reiner Case Update: DA Will Not Pursue Death Penalty
Nick Reiner’s murder trial is set to move forward after today’s pretrial hearing, but the 32-year-old accused murderer has cleared one legal hurdle: he will not face the possibility of the death penalty should he be convicted of murdering his parents, Rob and Michele Reiner. Rob and Michele’s own stance on such legal issues may have helped him avoid that fate. Here is what we know so far.
Nick Reiner will not face the death penalty
Ahead of Nick Reiner’s pretrial hearing on September 15, TMZ reported that the district attorney’s office had made a decision on whether or not to seek the death penalty. The outlet claims Nathan Hochman opted not to pursue it for the younger Reiner. According to sources, the victims’ opposition to capital punishment, as well as the impact a death penalty trial would have on Rob and Michele Reiner’s surviving children, factored into the decision.
The death penalty had been on the table since Nick Reiner’s December 2025 arrest. The arrest came hours after he allegedly stabbed his parents, Rob and Michele Reiner, to death inside their Brentwood home. The death penalty can be pursued in cases of first-degree murder with special circumstances. Several special circumstances are attached to the case. Nick Reiner has pleaded not guilty to all charges.
Michele and Rob Reiner were reportedly opposed to capital punishment. Jake Reiner, the couple’s eldest son, spoke about the toll of the case in an interview with ABC News last month. He described the experience as something outsiders can’t fully grasp. He declined to speak on the topic of his younger brother. Instead, he focused his interview on his parents and the aftermath of their deaths. Romy Reiner, Michele and Rob’s youngest child, has not spoken publicly yet.
Where does the case currently stand?
While Nick Reiner has not gone to trial yet, the case is moving quickly. He was arrested by Los Angeles police officers just hours after his parents were found dead inside their home on December 14.
Since then, he has been held at the Twin Towers Correctional Facility without bail and has moved through several court hearings. A grand jury returned an indictment on July 20 that added a further special-circumstance allegation that he committed the killings by lying in wait, along with an allegation that he personally used a knife in the attack. The indictment was unsealed, and he entered his plea to it on August 12. Throughout the case, Hochman had repeatedly said the death penalty decision was an ongoing, rigorous process that would weigh aggravating and mitigating factors. Hochman also noted, at that time, that family input was being considered.
In the background, Nick Reiner has also been fighting for access to a trust fund. According to several reports, Reiner is seeking access to the trust to help pay for his defense. Disputes have arisen over California’s Slayer Statute and whether he was entitled to a payout before his parents’ deaths. A separate October hearing will address his request to access the $1.5 million trust. A trial date for the criminal charges has not been set.
