The ‘Biggest Question’ After D4vd’s Defense Team Withdraw, According to Attorney
The singer D4vd recently stunned a courtroom when he announced that he had parted ways with his defense team. Instead, he wants a public defender to represent him. D4vd, whose real name is David Burke, allegedly murdered 14-year-old Celeste Rivas Hernandez. An attorney shared some of the biggest questions moving forward.
D4vd parted ways with his defense team
On August 31, Burke and his defense team parted ways. His defense attorneys Blair Berk and Regina Peter will no longer represent him in his murder trial.
“This morning the court granted our request to withdraw as counsel and appoint the Los Angeles County Public Defender’s Office after it was determined David qualified for appointed counsel,” Berk said in a statement, per NBC News. “We continue to support David and his defense against these serious charges. We are grateful that the Los Angeles County Public Defender’s Office has taken over the representation and that David has a highly capable and committed team of attorneys and investigators behind him.”
At this point, it is not clear why Burke and his attorneys parted ways.
A lawyer weighed in on the questions for D4vd’s new defense team
Burke’s new attorney is public defender Walid Fouad Kandeel. Attorney Miguel Custodio explained that Burke’s new representation may not take a new approach. They need to determine the most effective method of defending Burke.
“It does not mean the defense is changing its strategy,” he tells Showbiz Cheat Sheet. “The new defense team is stepping into a complex case, how effectively they can do that could have a meaningful impact on the outcome for D4vd.”
He said that moving forward, the biggest challenge for Kandeel will be examining the case without delay.
“The biggest question now is whether the new defense team can quickly absorb the amount of material in this case without missing a beat,” he said. “Once a case reaches trial, the defense doesn’t have to solve the entire crime. Its job is to cause doubt over the prosecution’s evidence.”
Los Angeles County Superior Court Judge Charlaine Olmedo offered to give Kandeel more time to prepare if necessary.
The public defender’s office issued a statement
In a statement, the public defender’s office offered their condolences to the family of Hernandez. Still, they plan to represent Burke to the best of their ability.
“We recognize the loss of life underlying the allegations and extend our sympathies to those who are grieving,” they said in a statement. “At the same time, David Burke is entitled to a defense that takes his circumstances seriously and carefully examines the evidence. We are committed to providing him with that defense.”
Burke remains in custody without bail.
