KJ Biermann Pleads Not Guilty as Juvenile Transfer Could Decide 25-Year Prison Sentence
Kim Zolciak’s son KJ Biermann currently faces seven felony charges in a sexual battery and sodomy case. Police arrested him following an April incident in which a female classmate accused him of assaulting her. KJ recently pleaded not guilty, and his lawyer requested that the judge move the case to juvenile court. If they don’t, KJ could face 25 years behind bars.
KJ Biermann has now pleaded not guilty to the seven felony charges against him
On August 17, police arrested KJ. Per Page Six, a 14-year-old female classmate alleged that he trapped her in a co-ed sauna and tried “multiple times to have sexual intercourse with her by trying to pull down her pants.” He was charged with aggravated sexual battery, aggravated sodomy, aggravated child molestation, three counts of aggravated sexual battery against a child under 16, and false imprisonment.
KJ, who maintains his innocence, recently pleaded not guilty to all seven felony charges against him. His lawyer, Jason Sheffield, also told the judge that KJ waived his formal arraignment. He also requested a hearing date to move the case to Fulton County Juvenile Court. If KJ is tried as an adult, he could spend 25 years in prison. This is the mandatory minimum.
His lawyer also defended him against other allegations
In court, prosecutors claimed that they found video footage on KJ’s phone of him having sex with an underage female family member. Sheffield defended his client against these claims.
“The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case,” he told Page Six. “The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense. Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”
Deputy District Attorney Caitlin McGillicuddy revealed that KJ had been under court supervision following the alleged incident.
“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims,” she said.
KJ Biermann’s mother, Kim Zolciak, also said he is not guilty
Zolciak, a former star of The Real Housewives of Atlanta, has publicly defended her son. She said that the 14-year-old classmate’s allegations are false.
“The allegations being made against my son are nothing short of reckless and deeply troubling,” she told E! News in a statement. “He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.”
She also said that she believes the evidence will prove that he is not guilty.
“We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations.”
